Terms for Artist Enrolment

Indian Art Exchange (IAE) (www.indianartexchange.com) is an art collective that bridges the gap between the artist and the connoisseur. Listing of artists on the IAE platform is by invitation only. If you choose to showcase your art work on the IAE website, you should agree to the following terms and conditions:

  1. You accept the invitation to showcase your art work on the IAE website www.indianartexchange.com for sale or for exhibition.

  2. You should be above 18 years of age.

  3. You promise to showcase only original art work created by you and also undertake that your art work is not a copy of art in any other form by any other artist.

  4. You have the right to decide the value of your art works.

  5. The displayed value of your artwork will include the value of your art work + the packaging cost + the courier cost + the insurance cost if any + 25% IAE mark-up.

  6. Example of artwork value displayed on the IAE website:
    Rs. 10,000/- (assumed value of your artwork decided by you)
    Rs. 1,000/- (assumed cost for having your artwork packaged for transit in a sturdy packing# to prevent any damage)
    Rs. 1,000/- (assumed cost for having the art work delivered to any place in India*)
    Rs. 1,000/- (assumed cost for having the art work insured for transit~)
    Rs. 13,000/- (Total value for the artwork to be paid to you)
    Rs. 3,250/- (25% IAE mark-up added to the total artwork value payable to you)
    Rs. 16,250/- (Final value displayed on the IAE website)

  7. NOTE: In case GST is applicable on the IAE platform, it would be added to the final value displayed to the buyer on the IAE website and this shall not affect the total value for the artwork to be paid to you.
    # Invest in a good and robust packaging material / service since the cost would be build up into your final value paid by the buyer.
    * While estimating the cost of delivery, consider the cost for delivering the art work to the farthest location in India.
    ~ Reputed delivery partners like DHL, FedEx, Blue Dart etc. may provide you transit insurance for your art work.

  8. IAE does not hold exclusive rights to showcase your art work. You are free to simultaneously showcase your art work on other platforms also. However, it would be your responsibility to immediately inform IAE about the non-availability of your art work if it has been sold outside of IAE.

  9. A penalty clause of 10% of the order value for non-fulfilment of paid order received for your art work will be applied in case you are unable to deliver the art work to the buyer because of its unavailability due to sale executed outside of IAE and the same was not informed to IAE. Such penalty shall be deducted from the subsequent payment outgo of the artist. The artist may be delisted if he/she defaults for the second time. 

  10. The artist undertakes that he/she shall not strike a business deal for any of the art work listed on the IAE website with a person/company directly or indirectly with the knowledge that the person/company has shown interest in the art work through the IAE channel. IAE shall trust upon the word of the artist at all times. However, in case any violation of this clause is brought to the notice of IAE management, IAE reserves the right to delist the artist with immediate effect and any dues towards IAE from the artist shall be deducted from any balance payments due to the artist from IAE.

  11. IAE reserves the right to accept or refuse to showcase any of your art work without assigning any reason. The decision of IAE in this regard shall be final and binding.

  12. Your invitation to enrol and showcase your art work on the IAE platform is free. IAE may accommodate more or less numbers of your art work at its discretion.

  13. IAE on its discretion shall have the right to display or remove some or all of your art works without prior notice.

  14. IAE may decide to apply a fee for using the IAE platform and any of its services in the future only with prior intimation and approval from you.

  15. You are solely responsible for the content that you provide to be displayed, whether be it art work or text details. IAE may assist you in curating the description and biographical expressions in textual form but is not obliged to do the same.

  16. You have read and understood the IAE processes detailed below:
    IAE makes all efforts to make the platform as transparent as possible to safeguard the interests of the art buyer as well as the artist. IAE understands that buying or selling original art over the internet may be a tricky deal and hence the levels of transparency incorporated by IAE shall be assuring for the art buyer as well as the artist.
    The IAE Purchase Process: While the art buyer can proceed with an instant check-out for items valued below Rs. 5,000 on the IAE website, artworks valued over Rs. 5000 can be purchased after previewing its current video. The art buyer shall pay 5% of the art value as ‘token amount’ to show ‘intent of purchase’ and request for a current video footage of the artwork. You shall arrange to showcase a current video of the artwork. Once the art buyer is satisfied with the current state of the artwork, the balance 95% payment shall be done by the art buyer and the sale shall be executed with the delivery process of the artwork. In case the art buyer who after showing ‘intent of purchase’ as mentioned above, decides not to go ahead with the purchase of the art work, the 5% amount deposited by the art buyer shall be refunded to the buyer. In such situations where the sale is not executed, the artist shall not stand to gain from this exercise.
    Safeguarding the Art Buyer: The art buyer shall pay 5% of the art value as ‘token amount’ to show ‘intent of purchase’ and request for a current video footage of the artwork. The artist shall arrange to showcase a current video of the artwork. Once the art buyer is satisfied with the current state of the artwork, the balance 95% payment shall be done by the art buyer and the sale can be executed with the delivery process of the artwork. The artwork shall be packaged with diligent care by the artist to ensure that it does not get damaged in transit. It should be noted that there may be differences in the appearance of the artwork on video due to lighting conditions and the surroundings under which the video would have been shot. However, if the art buyer is not satisfied with the artwork for whatsoever reason, he/she can ask for a full refund of the token amount and the deal stands cancelled. The token amount for ‘intent of purchase’ is introduced to eliminate any unnecessary demands from art buyers and only genuine art buyers who actually intent to purchase the art work shall make a request for the video of the art work in its current state.
    Safeguarding the Artist: In the rare case where an artwork gets delivered in a damaged condition while in transit, the art buyer to be eligible for a refund or return shall have to document the sealed parcel and the unpacking of the sealed parcel until the final artwork is clearly visible in a continuous unedited video as proof of damage to the artwork. There is obviously no dispute if the artwork is received in perfect shape and condition as seen in the video shared by the artist as would be usually expected to be delivered. In rare cases, if any damage is noted and documented, the same shall be shared with the artist and an amicable resolution of the case shall be sought. Any arbitration in this regard shall be settled between the art buyer and the artist. In case any genuine damage occurs during transit and the sale has to be cancelled, the artist would be secured as the painting would have already been insured.
    In case of returns: In cases where the art work needs to be returned by the buyer, the cost of courier shall be borne by the artist.

  17. You shall provide a signed certificate of authenticity for your artwork to the buyer along with the art work in the format provided by IAE.

  18. Details required for registration:
    We require the artists who avail the IAE platform or its services to provide us with the following information:
    1. Name of the Artist
    2. E-mail Address
    3. Phone Number
    4. Postal Address
    5. Tax-Payer Identification Number (PAN)
    6. All other information as required by IAE to on-board the Artist.

  19. Any payments to be made to you by IAE shall be done after deducting any applicable TDS.

  20. You are required to check if all the information related to your art work and yourself is correctly uploaded on the website and that all the links to respective webpages are correctly incorporated. If there is any discrepancy it should be brought to the notice of IAE immediately and IAE shall take measures to rectify the same.

  21. Should you decide to alter the value or description of your art work at any time, you should inform IAE giving it reasonable time to implement the changes.

  22. You are also suggested to go through the terms and conditions and policies mentioned on the IAE website.
